GENERAL TERMS OF SALE

These terms define the procedure for ordering, payment, delivery, and product claims offered on our website.

BrandCanvasStudio is an online store that sells templates for comprehensive branding of your business. Each template can be customized by the Buyer. If the Buyer wishes, she/he can contact us for an agreement on the branding process at brandcanvasstudio@gmail.com. We will be happy to participate in the process of branding your brand/site etc.

The Buyer of the products is a visitor to the online store who selects at least one product, completes an electronic order form, and sends it to the Seller.

After the Buyer has made the payment for the selected product/s, Buyer will receive an e-mail confirmation that the Seller has received the payment.

If you do not receive this message, please check:

1. Whether the message is in your Junk/Spam folder.

2. Whether your mailbox is full.

3. Whether the items are in your cart after logging in to  the BrandCanvasStudio website, and if so, repeat the ordering process.

The prices of products are expressed in Euros and US Dollars.

The Buyer is obliged to make the payment within seven days from selecting the product. Otherwise, the offer will be automatically canceled, and the Buyer will be informed by email, which Buyer entered during registration.

In case the Buyer makes the payment on time and does not receive a notification to the email address entered during registration, the Buyer is obliged to inform the Seller within two days.

The Buyer undertakes to pay for the ordered.

You can pay for ordered products in the following ways:

1. Via Standard Paypal on their web site.

2. Maestro, MasterCard, Visa, Visa Inspire, Diners, Premium Visa, or Discover cards.

3. Fast Check-Out via Paypal with Maestro, MasterCard, Visa, Visa Inspire, Diners, Premium Visa, or Discover cards.

After receiving and confirmed payment your digital products wil be ready for instant download on Buyer dashboard where you as Buyer are registered where you registerd during registration.

4. Paypal account

Paypal payment is the fastest and most secure form of online payment.

The monetary obligation paid by the Buyer through the payment service provider shall be deemed settled on the day when the payment service provider received the payment order from the Buyer and when that order became irrevocable in accordance with the provisions of the law governing payment transactions.

The purchase contract is concluded at the time of receipt of payment.


2. INSTANT DOWNLOAD

After you purchase products in the online store and you payment is confirmed, you can immediately download the purchased item from buyer dashboard.

3. RETURN / COMPLAINT OF PURCHASED PRODUCTS

RETURN & REFUND POLICY

Before confirming your purchase, feel free to message us with any questions. We shall be pleased to help you. Our preferred method of communication is by email at brandcanvasstudio@gmail.com. We should respond to you quickly because we check that often.

NOTE:

Digital products are non-refundable because they can be downloaded right away after purchase.

  • You can not create digital and physical items for sale.
  • You can not redistribute or gift original files / altered files to a third party. 
  • You can not repackage and resell original files / altered files in any form.

4. COMPLAINTS AND APPEALS

In accordance with Article 8, paragraph 2 of the Consumer Protection Act (Official Gazette, No. 79/07, 125/07 – correction, 79/09, and 89/09 – correction), Buyers are hereby informed that they may submit a complaint about the quality of our services in writing to the following address:

We will respond to your complaint in writing no later than 15 days from the day of receipt of the complaint, either by mail or email.


5. DEADLINE FOR COMPLETION

The Seller undertakes to fulfill the sales contract without delay. After you purchase product/s in the online store and you payment is confirmed, you can immediately download the purchased item/s from buyer dashboard.

6. RIGHT TO UNILATERAL TERMINATION OF THE CONTRACT

The Buyer can unilaterally terminate the contract, without stating the reason, at any time before the Buyer's payment is visible on the Seller's account. After the Buyer's payment becomes visible on the Seller's account, the Buyer cannot cancel the contract.
 

The Buyer is obliged to inform the Seller of their decision to terminate the contract before the Buyer’s payment becomes visible on the Seller’s account.

The Buyer must send the statement of contract termination electronically to the Seller’s email address brandcanvasstudio@gmail.com before the the Buyer’s payment becomes visible on the Seller’s account.

Effect of unilateral contract termination:

 

Again, take into account that our products are only and exclusively downloadable, they are available for download immediately upon visible payment, and we, the Seller, cannot know whether the Buyer has downloaded the purchased product because the download product is only available to the Buyer in the Buyer Dashboard.

The products that the Seller sells and the Buyer buys on the BrandCanvasStudio site are only and exclusively instant downloadable. For this reason, once the Buyer's payment becomes visible on the Seller's account, a refund of money and/or products is not possible for any reason whatsoever.
 

7. ISSUE OF R-1 INVOICE

An R-1 invoice is issued and sent with email. The Buyer is responsible for providing the necessary information when placing an order.


8. LIABILITY FOR MATERIAL DEFICIENCIES

The Seller on the BrandCanvasStudio site sells scalable products. The customer can choose the size of the product according to her/ his needs and have it printed for only own needs or have it printed in a copy shop.
The Seller disclaims any responsibility and is not responsible for the personal impression of the Buyer and/or personal expectations that the Buyer may have, or that may be suggested to Buyer by third parties.

9. EXPIRY DATE OF THE PRODUCT AND THEIR USE

All products on the Seller’s website are digital products and there is no expiration date.

The Seller does not assume any responsibility for the use of information published on the website of the online store.

10. STATEMENT ON PROTECTION AND COLLECTION OF PERSONAL DATA AND THEIR USE

Privacy Policy describes how the Seller handles your personal information that it receives while using the Online Store. Personal data includes your identification data: name and surname, e-mail address, home address and telephone number, or data that are not otherwise publicly available, and which the Seller learns about during your use of the Online Store.

The Seller will keep your personal data confidential and will not distribute, publish, make it available to third parties for use or in any other way make it available to any third party without your prior consent. You can read more about the security of your data in “Data security” which we have improved and harmonized with the conditions set by the European Commission for implementation GDPR regulation (General Data Protection Regulation).


11. CHANGES

The Seller reserves the right to change these terms and conditions, and excludes its responsibility for the possible consequences of such changes and undertakes to notify all registered users via the e-mail address they entered during registration.


12. REGISTRATION

The Buyer is responsible for the accuracy and completeness of the data entered during registration. If there is any change in the information you entered during registration, you must immediately update your account to notify us of any changes.


15. PRODUCT PRICES

15.1 All product prices are retail. Product prices and sells prices are expressed in Euros and US Dollars and include the corresponding VAT. For technical reasons, when choosing to pay with Paypal, prices are expressed in Euros or Dollars, you can choose.

15.2 The process of entering the price on the website for each product is subject to control at several levels, but regardless of this, there is a possibility of error, since it is not an automatic entry. Such situations are extraordinary and the Seller apologizes to their Buyers in advance because they will be forced to inform them about the situation, the wrong price for a particular product, and the inability to deliver to a specific Buyer order.

15.3 Seller is authorized to change prices without prior notice as it is authorized without prior notice to change prices for Online Purchase.

15.4 The Seller is authorized at any time to determine the sale, daily or weekly promotional sales for an individual Product, a group of Products and / or for all Products.

15.5  Buyer will be able to purchase certain products and/or groups of products that the Seller has marked on the BrandCanvasStudio web site and/or advertised via social networks only for a limited time and only under the conditions advertised by the Seller.
Prices, payment terms and special offers are valid only at the time of ordering.

Your sensitive/credit information is encrypted through SSL technology and transferred to our Payment gateway providers database which can only be accessed by authorized personnel with special access rights who are legally obligated to keep it confidential. We do not retain credit/debit card data on any of our systems for added precautionary purposes.

How long we retain your data

At Adela Natural j.d.o.o.(BrandCanvasStudio), we store contact form entries for six months and analytics records for a year. Additionally, customer purchase records are kept on file for ten years.

Comments made by users will be retained indefinitely along with their metadata so that any follow-up comments can be automatically approved without moderation delay.

If you register an account with us, your personal information is stored in your user profile. You have the option to view, modify or delete this data at any time excepting username changes which aren’t possible. As website administrators also possess access to this information they may make necessary adjustments as required.

What rights you have over your data?

If you possess an account or have made comments on this website, you may ask for a copy of the personal data we retain about you. Such information encompasses all details furnished to us by yourself. Additionally, it is possible for you to request that any such records be erased from our database; however, please note that administrative, legal and security obligations prevent complete elimination at times.
